By installing, accessing, or using the Image Analyzer Google Sheets add-on ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Image Analyzer is a Google Sheets add-on that provides AI-powered image analysis capabilities through custom functions. The Service allows users to:

• Analyze images using various AI models (GPT-4 Vision, Gemini Pro Vision, Claude 3)
• Use the =ANALYZEIMG() custom function in Google Sheets
• Access structured analysis tools through a sidebar interface
• Manage usage and subscriptions through a freemium model

3. Eligibility

3.1 Age Requirements

You must be at least 13 years old to use this Service. Users between 13 and 18 must have parental consent.

3.2 Google Account

You must have a valid Google account and access to Google Sheets to use this Service.

3.3 Compliance

You must comply with all applicable laws and regulations when using the Service.

4. User Accounts and Authentication

4.1 Account Creation

Accounts are created automatically when you first authenticate with your Google account. By authenticating, you authorize us to access:

• Your Google account email and name
• Your Google profile information
• Google Sheets where you use the add-on

4.2 Account Security

You are responsible for maintaining the security of your Google account. We are not liable for any loss or damage from unauthorized access to your account.

5. Subscription Plans and Pricing

5.1 Available Plans

• Starter Plan: 100 API calls per month (Free)
• Pro Plan: 1,000 API calls per month
• Business Plan: 10,000 API calls per month
• Enterprise Plan: Custom pricing for unlimited usage

5.2 Billing

• Subscriptions are billed monthly or yearly in advance
• All payments are processed through Stripe
• Prices are subject to change with 30 days notice
• All fees are non-refundable except as required by law

5.3 Usage Limits

• Free tier users are limited to 100 API calls per month
• Paid subscriptions have limits as specified in the plan
• Usage resets monthly on your billing date
• Exceeding limits may result in service suspension until the next billing cycle

6. Acceptable Use

6.1 Permitted Uses

You may use the Service to:

• Analyze images for legitimate business, educational, or personal purposes
• Integrate image analysis into your Google Sheets workflows
• Use the Service in compliance with all applicable laws

6.2 Prohibited Uses

You may NOT use the Service to:

• Analyze illegal, harmful, or inappropriate content
• Process images containing personal information without proper consent
• Violate any third-party rights, including copyright or privacy rights
• Attempt to reverse engineer, hack, or circumvent the Service
• Use the Service for any unlawful purpose
• Analyze images of minors without appropriate consent
• Process medical, financial, or other sensitive personal data without proper authorization
• Generate content that is defamatory, harassing, or discriminatory

7. Intellectual Property

7.1 Service Ownership

The Service, including all software, interfaces, and documentation, is owned by us and our licensors. You receive a limited, non-exclusive license to use the Service.

7.2 Your Content

You retain ownership of images and content you submit. By using the Service, you grant us a limited license to process your content solely to provide the Service.

7.3 AI-Generated Content

Results from AI analysis are provided "as-is." We make no claims of ownership over AI-generated responses, but you are responsible for their use.

The Service integrates with third-party AI providers:

• OpenAI (GPT-4 Vision)
• Google AI (Gemini Pro Vision)

Your use of these services through our platform is subject to their respective terms of service.

8.2 Google Services

This add-on operates within Google Sheets and is subject to Google's terms of service and policies.

8.3 Payment Processing

Payments are processed by Stripe, subject to Stripe's terms of service.

9. Privacy and Data Protection

10. Service Availability and Performance

10.1 Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.

10.2 Performance

AI analysis speed and accuracy depend on various factors including AI provider availability, image complexity, network conditions, and service load.

11. Disclaimers and Limitations

• We do not guarantee the accuracy, completeness, or reliability of AI outputs

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

12. Termination

You may terminate your account at any time by canceling your subscription, uninstalling the add-on, or contacting us to request account deletion.
